The Provincial High Court had failed to analyze and conclude that the virtual complainant had not been deceived by the impugned conduct of the Appellant, which is a necessary ingredient to constitute a charge of cheating. In view of the above, I conclude that both the judgments of the High Court and the Magistrate’s Court are against the weight of the evidence and are not lawful. In the circumstances, I allow this Appeal. Accordingly, I acquit the Appellant of the charge of cheating.
