In my view a court cannot complement the doubts and fill in the gaps of the prosecution case by seeking to pick holes in the evidence of the Appellant. That will be contrary to the concepts of the burden of proof and the standard of proof the prosecution is expected to maintain. I therefore allow the appeal upholding all the grounds of appeal, quash the conviction and sentence and make order acquitting the Appellant forthwith.
